HFSS Stands for food and drink that is high in fat, salt and or sugar.

Implemented in October 2022. The regulations provide restrictions on the promotions and placement in retail stores and their online equivalents of certain foods and drinks that are high in fat, salt or sugar (HFSS) or 'less healthy'. [source: www.gov.uk,September 2023]

Which Businesses will be affected?

In scope:

Business greater than or equal to 50 employees (including onine retailers and retailers who do not primarily sell food or drink) and stores that are a member of a symbol group or franchise, where there are 50 or more employees operating under that business name.

Out of scope:

• Micro (fewer than 10 employees) and small businesses (10 to 49 employees) out of scope for price and location promotions.
• Specialists retailers that only sell one type of prooduct and this is within the product categories in scope of the restrictions, for example chocolatiers or sweet shops- out of scope for location promotions only.
• Store areas less than 185.8 square meters (2,000 square ft) are out of scope for location promotions only.

Which store locations are restricted?

Store entrances- Within 3% of the store’s relevant floor areas up to 15m

Designated queueing areas- Within 2M unless in a main aisle.

Checkouts- Within 2M unless in a main aisle.

End of aisles- Adjacent to main aisle or separate structure within 50cm of an end aisle.
